Terms Of Service
Cyprus Web provides websites and web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Cyprus Web are subject to the following terms of service:
General Terms
Indemnification Policy:
You agree to use all Cyprus Web services and facilities at your own risk. Cyprus Web specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Cyprus Web be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Cyprus Web harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Cyprus Web, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Cyprus Web against liabilities arising out of
Any injury to person or property caused by any products sold or otherwise distributed in connection with Cyprus Web’s server. Cyprus Web reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Cyprus Web’s server. Cyprus Web shall be the sole judge of what violates this Policy.
Acceptable Use Policy:
All services provided by Cyprus Web may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any British law is prohibited. This includes, but is not limited to copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statutes. The subscriber agrees to indemnify and hold harmless Cyprus Web and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced.
Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Cyprus Web servers. This includes sites that include sexually explicit or hardcore images and/or advertising. Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company’s liability for its own negligence may not, in any event, exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury. Illegality In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
Limitation Of Liability:
Cyprus Web shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Cyprus Web servers going off-line or being unavailable for any reason whatsoever. Furthermore, Cyprus Web shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of the Cyprus Web servers. All damages shall be limited to the immediate termination of service.
Domains
Renewal Policy:
We are not a Domain registrar. We use a third party to register Domains. Although we do our best to manage your domain and in most cases they will renew automatically each year without issues, the responsibility for checking its renewal is down to the customer via services such as WhoIs.
For .co.uk domains, warning emails should be sent out from Nominet (The Official Registry for UK Domain Names) directly to the customers email in case of any potential expirations. These should be treated with urgency to avoid loss of your domain.
Billing
Payments:
At this time we bill monthly and annually, depending upon the plan. We accept Visa, Master Card, American Express, Discover, JCB and Diners Club cards.
Refund Policy:
Due to the amount of time and money spent initially by us on each package, no refunds are possible for any Pay Monthly Website Plan or Website Design work of any kind. If you are using our hosting only, then you may be applicable for a refund if it is not as described by us. Domain Name registrations are non-refundable without exception.
Late Payments:
All accounts are billed according to the dates they were first activated on. Your account will be suspended 5 days after payment due date if no payment was received. You will receive email reminders before any action is taken. If you fail to pay after 30 days, your account may be terminated and your files deleted at our discretion.
Affiliates, Promos & Incentives
Incentives / Promos:
Cyprus Web has many incentives to subscribe to our services and although your claim will most likely be accepted, they are judged on a case by case basis and we hold the right to decline any incentive claim at our discretion. Some common guidelines are: You will only receive introductory free hosting for the duration of your current providers contract, if that contract is set to expire within six months. We will not beat or match the price of a competitor for any package that gives fewer features than the package you wish to take out with us.
Affiliates:
This system can alter purely at the discretion of Cyprus Web and we are absolutely not bound to any legal requirement to pay our customers. Our customers will only receive money from subscription services that they sell – such as Hosting and Pay Monthly Websites. Services such as bespoke web design that are paid for in one/multiple lump sums are not included. Your affiliate payments are delayed by 60 days to protect us from fraudulent activity.
Pay Monthly Websites
Designing limitations
We create professional websites using the content you supply us. We require any wording you desire so that we can copy and paste as is. We do tidy content up grammatically but will not do any creative writing without additional costs.
We use images that you supply us or stock images where appropriate. We do not create graphical elements such as flyers, banners, image mockups or logos without additional fees.
Inclusive Updates
Our plans include free updates and maintenance. This means that we will maintain the health of your website by fixing any faults and update all of the software on your behalf. Although we create a admin area for all our customers to make their own content changes, we can also add content for the customer. This is limited to one adjustment per month. The adjustments do not roll over month by month. Each adjustment can consist of any amount of work limited to 15 minutes labor. We often complete adjustments within 48 hours but are by no means obligated to do so. As a general rule, please allow 2 weeks for work to be completed.
If you require a faster content update service or more than one adjustment per month made by us, then we have “VIP bolt-ons” available either at the registration process or by request.
Support
We are a small business with a focus on offering low-cost services to our customers. Due to this, our support is exclusively email-based. The phone line is available for presales and urgent matters.
If you require a significant amount support after the website has been created then we will arrange a custom plan for you to cover the costs. What we define as significant is at our discretion, but generally speaking, if we continuously spend over 30 minutes per month dealing with a customer, we will begin to consider if the pricing needs to be increased for them. This philosophy is to protect everybody else from price hikes and to keep our services the lowest costing on the market.
Email Support
We offer free email as a courtesy. Beyond server related faults, we are not liable to support email issues as they are considered as a local problem and should be dealt with by an IT technician or the Email Clients software support team.
We will aid you in setting up a single email address, and from there it is up to you to configure it for team members. It is recommended, however, if you have a team, to use an independent business email service, such as Gsuite.
If you require more than one email address, we will set these up for you and you will be charged £1 per additional address.
Storage Space
Each website is given 5GB of space on our servers. This is a huge amount of space which will store the website files, databases and Emails. For those who require more space will need to pay for an additional bolt-on, which can be purchased either at the registration process or by request.
Buying A Pay Monthly Website
Our pay monthly websites are to be looked at as an ongoing service for the lifetime of the customer’s website and not a finance arrangement where the monthly payments are being deducted from the value of the website. If a customer decides to buy their website then the fee’s are worked out on a case by case scenario.
However, as a general rule, 75% of the monthly payment’s go towards non-refundable items such as admin fees, bills, hosting costs, domain costs, server side work, content updates and fundamental website upgrades. The remaining 25% can be deducted from the value of the website. The value of the website will be taken from the present point in time, including any increases in company prices and the websites new content. The price will not be frozen in place from when the pay monthly plan was initiated.
Once the purchase has been made, all of the inclusive services and support will no longer exist and will need to be paid for separately – whether to us or to another company. This includes but is not limited to hosting, domain registration, support, content updates and maintenance.
Hosting Fair Usage
The ‘shared server’ hosting environment is the hosting solution for our web hosting plans. A server’s resources, such as RAM (memory) and CPU (processor), are shared amongst all accounts on the server. We ensure that the server has plenty of capacity to meet the day-to-day needs of the vast majority of web sites, ensuring also that the demands for resources are met even at peak times. Given that resources are shared amongst all users, this also makes it possible for web sites to use too many resources to the detriment of other customers hosted on the same server. This can happen for many reasons, but the most common causes are due to poor coding, compromised accounts or a very abnormal influx of visitors to the site. Allowing sites to utilise more than their fair share of resources could lead to a poor quality of service for the remaining clients on the server.

Moreover, Cyprus Web holds no responsibility for the use of our clients’ accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Cyprus Web sees fit. FURTHERMORE, Cyprus Web retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
